TRIBUNAL OBLIGA RENEGOCIAR TLC CON CHILE
 El Tribunal Constitucional ha declarado infundada la demanda de inconstitucionalidad al TLC con Chile, apoyada por un grupo de patriotas que se resisten a  aceptar el avasallamiento económico de Chile.

            Sin embargo, ha condicionado la constitucionalidad del Tratado a  dos requisitos:


a) Precisar el concepto y ámbito de territorio. En efecto, el Tribunal señala que el Tratado: “no es inconstitucional, siempre que se interprete el concepto de “territorio continental, las islas, los espacios marítimos y el espacio aéreo bajo su soberanía (..) de conformidad con el articulo 54 de la Constitución”. Es decir, deberá señalarse que la soberanía y jurisdicción que le compete al Estado  peruano abarca el dominio marítimo que ejerce sobre las 200 millas marinas adyacentes  a sus costas.

 Como este requisito no está en el Tratado, éste es inconstitucional, hasta que tal precisión se añada.

 b) Incluir el criterio de seguridad nacional como una de las causales de expropiación, ya que el Tribunal dice: “no es inconstitucional, siempre que se incorpore a la seguridad nacional como un supuesto jurídico mas de expropiación” como lo señala el articulo 70 de nuestra Constitución.

Es decir deberá incorporarse el concepto de seguridad nacional como uno de los supuestos de expropiación y hasta que ello no ocurra el Tratado es inconstitucional.

            En consecuencia el Tribunal ha establecido, a través de este fallo, que para que el Tratado sea constitucional debe contener estos dos requisitos. Para que ello ocurra el Perú deberá renegociar con Chile la inserción de tan fundamentales condiciones, ya que es un acuerdo bilateral. En el hipotético caso que ello no ocurriera el Presidente de la República y el Canciller estarían asumiendo una grave responsabilidad histórico-política y constitucional.

             Hacemos este pronunciamiento en vista de la información distorsionada que se ha dado a la opinión pública en el sentido que el Tribunal ha dado luz verde a este Tratado, lo cual no es cierto.

    Ademas, te estan engañando, ya que el tribunal determino que no es "inscontitucional", ya que lo que plantearon los demandantes, era totalmente ajeno a lo que el tratado buscaba.
